Services

Vance Music Studios agrees to provide quality music instruction to you according to the following terms:

Tuition Fees

$24 per 30 minute lesson OR $48 per 60 minute lesson.

Ensembles are an additional fee of $24 per session for VMS students OR $30 per session for NON-VMS students. This fee is DUE MONTHLY and must be paid IN ADVANCE.

Summer Camps are an additional fee of $359 per session for VMS students OR $399 per session for NON-VMS students. This fee is DUE IN ADVANCE.

Enrollment Fee and Initial Tuition Payment

All new students must pay a $30.00 enrollment fee due prior to the time of the first scheduled lesson. In addition, the remaining pro rated amount for lessons for the month of enrollment and the entire second month of tuition is also due prior to the time of the first scheduled lesson. The enrollment fee is nonrefundable.

Payment

Tuition is payable via cash, personal check, money order or credit card. Tuition is due the last lesson of the previous month regardless of any pending credits. All tuition is payable, in advance, by the calendar month. By signing below, you are acknowledging that you are responsible for one month's tuition, every month, until such a time occurs that you withdraw from lessons as per our policies as indicated in the Withdrawal section located below. A late fee of $30 will be assessed if tuition is more than a week late. The late fee will be assessed monthly on any outstanding balances, at the rate of $30 per month. Any accounts over 60 days are subject to any variety of collection methods deemed appropriate by VMS, including but not limited to: submission to a collection agency, filing a claim in small claims court, etc. Habitual problem accounts will be subject to a one month (4 lesson/ensemble rehearsal) deposit in order to remain enrolled.

Attendance/Cancellations

You are expected to attend all scheduled lessons. If you are not able to attend your scheduled lesson, you must advise VMS by noon of the day of your weekday lesson or by 9pm the previous night of your weekend lesson in order to receive consideration for a make-up lesson. Make-up lessons are offered as a courtesy. This courtesy can be withdrawn if absences are deemed excessive by VMS. If you cannot attend any of the courtesy make-up lessons offered by VMS, tuition for that lesson is forfeited. Arriving 15 minutes late for your lessons is considered the same as a No Show for the lesson. No refunds for missed lessons are provided.

Make up Lessons/Credits

Lessons can be cancelled at no penalty if VMS is notified when payment for that month is received. A make-up lesson will be offered or tuition will be pro-rated at the students (or student's parent/guardians) discretion. Vance Music Studios will make all reasonable efforts to accommodate your schedule in the resetting of the missed lesson. Regardless of proper notification, you are permitted only 5 credits or make-up lessons within any one calendar year.

Weather Related Cancellations

If the weather prevents you or your instructor from attending your scheduled lesson, you will receive a credit on your next month's tuition or the option to reschedule the weather-cancelled lesson. The determination of a weather related lesson cancellation is at the sole discretion of Vance Music Studios.

Instructor Related Cancellations

All Vance Music Studio instructors are active performers. As such, their performance schedule may require cancellations of your lesson on rare occasions. In the event your instructor cannot attend your scheduled lesson, Vance Music Studios may substitute, at its sole discretion, another equally qualified instructor for that lesson. If a suitable substitute is not available, you will be offered a rescheduled lesson. If you cannot attend the rescheduled lesson, a credit will be provided for a future month's tuition.

Student Conduct

Insubordinate behavior of any kind, foul language, fighting, use of drugs or alcohol, damage to studio property, stealing or any other inappropriate conduct will subject you to disciplinary action by Vance Music Studios. Any such violation will subject you to a warning. The accumulation of three warnings will result in removal from the lesson schedule without a refund to you of any amounts paid for remaining lessons. A single severe violation of the conduct policy, determined in the sole discretion of Vance Music Studios, will result in immediate removal from the lesson schedule without a refund to you of any amounts paid for remaining lessons. This applies to in the studio as well as any studio related concert or event.

Instructor Communication/Inter-Student Communication

VMS does not promote out of Studio communication with other students and/or their guardians. If you choose to communicate with other VMS students, you do so at your own discretion. Additionally, if such contact becomes inappropriate and effects the other student's relationship with VMS, you will be subject to disciplinary action as outlined under student conduct. You may not contact instructors other than by contacting Vance Music Studios and speaking with the instructor or leaving a message for them at Vance Music Studios. Instructors are not permitted to contact you outside of Vance Music Studios. By signing this contract, you acknowledge that Vance Music Studios has no liability for any violation by you of this provision regarding instructor communication or contact outside of Vance Music Studios.

Supervision of Minor Students

Vance Music Studios provides adult supervision only during scheduled lesson times. You acknowledge by signing the contract that VMS has no liability for your minor student, prior to or following the scheduled lesson time.

Ensembles

Students at VMS are offered the privilege of participating in ensembles. Such lessons/rehearsals are an additional fee of $20 per session, due monthly, in advance. If you are not a student of VMS but still wish to participate in an ensemble, the tuition is $25 per session, due monthly, in advance. This fee is for each student that wishes to participate and is used for studio space, equipment, and instructor coaching time at rehearsal. Ensembles are ongoing and are not guaranteed to coordinate with one of our scheduled performances. VMS provides more than ample performance opportunities at recitals, showcases, or any other studio sanctioned event. These opportunities occur at regular intervals throughout the year.

The instructor provided by VMS as the coach is the band leader without exception. Attendance of all scheduled rehearsals is required - ensemble tuition will not be credited or rescheduled. Rehearsals outside of VMS are not allowed. Participants' behavior in our ensemble program is expected to be of the highest standards, as outlined under Student Conduct section. Participants must behave in a manner that is respectful (of your coach and your peers) and as productive as possible. Any breech in expected behavior is grounds for immediate expulsion from the ensemble program with no refund. All outside communication between ensemble members must be made through VMS and by parents or guardians.

All ensemble students are required to be enrolled in private lessons on the instrument they play in the group unless special permission is given by VMS. Participation in ensembles is at the discretion of VMS.

Summer Camps

Students at VMS are offered the privilege of participating in Summer Camps. Camps are an additional fee of $359 per session, due in advance. If you are not a student of VMS but still wish to participate in a Camp, the tuition is $399 per session, due in advance. This fee is for each student that wishes to participate and is used for studio space, equipment, and instructor coaching/teching time. Each week long camp session will culminate in a performance at a local music venue, admission to these events may be charged.

The instructor provided by VMS as the coach is the band leader without exception. Attendance of all scheduled days of camp is required - tuition will not be credited or rescheduled. Participants' behavior in our camp program is expected to be of the highest standards, as outlined under Student Conduct section. Participants must behave in a manner that is respectful (of your coach and your peers) and as productive as possible. Any breech in expected behavior is grounds for immediate expulsion from the camp program with no refund. All outside communication between camp members must be made through VMS and by parents or guardians.

Unless otherwise specified by VMS, campers are required to bring a packed lunch each day.

Performances

Even without participating in the ensemble practice sessions, in the event you intend to participate in a public performance sponsored or organized by Vance Music Studios at which tickets are required, you agree to pay for 10 pre-sale tickets for re-sale at your discretion to friends and family members.

Automatic Renewal

This agreement automatically renews each year with the same terms unless amended in writing by Vance Music Studios.

Withdrawal from Lessons/Ensembles

Withdrawal from Lessons/Ensembles: Notice of Withdrawal must be given by the 20th of the month previous to withdrawal. If proper notice is given, you will not be charged for the following month or penalized in any way and you are able to re-enroll at any time without paying another registration fee. No refunds are given for partial months-i.e.: if you decide you cannot continue lessons at any time during the calendar month, you will not receive a refund. If you do not give proper notice and you decide to re-enroll, you will be charged the registration fee and an amount equal to 4 (four) lessons as a deposit upon your return, plus any tuition that would normally be due for that period. The deposit will be refunded to you upon your proper notification in the event that you will need to withdraw again.

Resolution of Disputes

You agree that any dispute arising under this agreement must be presented to arbitration under the rules of the American Arbitration Association and may not be resolved by the filing of a lawsuit. The parties agree to abide by the decision of any such arbitrator(s).

Severability

Any term of this agreement that is deemed unenforceable shall be severed from the agreement. All other terms of the agreement shall remain enforceable.

Cancellation

Vance Music Studios may cancel this agreement at any time with 30 days written notice to you.

Consultation with Counsel

You acknowledge you have been provided the opportunity to review this agreement with counsel of your choice prior to signing and agreeing to all of its terms.

Privacy Policy

VMS will keep confidential all contact information provided for the purposes of lessons. VMS does not sell or otherwise give student contact information for any reason.

Governing Law

The terms of this agreement shall be construed solely under the laws of the state of Ohio.
